1. Acceptance of Terms
By downloading, installing, or using the Diasporalia mobile application ("App") or related website experiences, you agree to be bound by these Terms of Service. If you do not agree, please do not use Diasporalia.
2. Description of Service
Diasporalia is a community marketplace platform connecting diaspora communities worldwide. We provide a platform for users to list and discover housing, vehicles, childcare, professional services, community events, and other lawful community-oriented goods, services, opportunities, or offerings that may be introduced from time to time. Diasporalia facilitates connections between users only and is not itself a seller, landlord, tenant, buyer, employer, employee, broker, agent, insurer, payment provider, escrow provider, transportation provider, service provider, or other party to any user transaction unless we explicitly state otherwise in writing.
3. User Accounts
You must create an account to use certain features. You are responsible for maintaining the confidentiality of your credentials, for all activities that occur under your account, and for providing accurate and complete information. You must promptly update your account information when it changes.
4. Eligibility and Compliance
You may use Diasporalia only if you have the legal capacity to enter into a binding agreement and if your use of the service is permitted under applicable law. You are responsible for complying with all laws, regulations, licensing rules, disclosure obligations, consumer protection requirements, and other legal obligations that apply to your listings, offers, services, communications, and transactions.
5. User Conduct
You agree not to post false, misleading, unlawful, or fraudulent listings; harass, threaten, discriminate against, or defraud other users; use the platform for illegal activities; attempt to reverse-engineer, disrupt, or compromise the security of the App or website; scrape, harvest, or misuse user data; or otherwise use Diasporalia in a way that harms other users, the platform, or third parties.
6. Prohibited Content and Content Moderation
Diasporalia is a community marketplace and we are committed to maintaining a safe and lawful environment. The following types of content and conduct are strictly prohibited:
- Illegal goods or services, including controlled substances, counterfeit items, stolen property, or any content that facilitates illegal transactions.
- Hate speech, or content that promotes discrimination or violence based on race, ethnicity, nationality, religion, gender, sexual orientation, disability, or any other protected characteristic.
- Harassment, threats, stalking, intimidation, or abuse directed at any other user.
- Sexually explicit or adult content of any kind. The platform is not intended for users under 18 and does not permit content that could exploit or harm minors.
- Spam, bulk unsolicited messages, phishing attempts, or deceptive content intended to mislead users.
- Fraudulent listings, including false pricing, fabricated availability, or misrepresented goods and services.
- Malware, viruses, or any code or content that could damage, intercept, or interfere with other users' devices or data.
- Personally identifiable information of other individuals posted without their explicit consent.
Moderation: We may remove content, limit account functionality, or suspend or permanently ban accounts that violate these standards. Moderation may be performed by automated systems, human reviewers, or a combination of both. We reserve the right to act without prior notice when content poses an immediate risk to user safety or platform integrity.
Appeals: If you believe a moderation action was applied in error, you may submit an appeal by contacting us at the address in the Contact section below. Include: (1) a brief description of the content or account action, (2) why you believe it should be reconsidered, and (3) any supporting information. We will review appeals in good faith and aim to respond within 14 business days. Appeals cannot be accepted for actions taken in response to illegal content, child safety violations, or credible threats of violence.
7. Listings and Transactions
Diasporalia is a marketplace platform. Users are solely responsible for the accuracy, legality, and completeness of their listings, profile details, communications, offers, meetings, payments, deliveries, services, agreements, and transactions. We do not verify or guarantee the identity, background, authority, licensing, reliability, quality, availability, safety, legality, condition, value, suitability, or performance of any user, listing, property, vehicle, service, job, event, payment arrangement, or third-party offer.
All transactions, communications, meetings, inspections, payments, deposits, refunds, chargebacks, deliveries, rentals, employment discussions, professional-service arrangements, and other dealings between users are solely between those users. Users assume all risks associated with those dealings, including fraud, scams, misrepresentation, nonpayment, property damage, theft, personal injury, unsafe conditions, failed performance, tax or licensing issues, disputes, and losses arising from meeting or transacting with other users. Users are responsible for conducting appropriate due diligence, meeting safely, complying with applicable laws, and deciding whether and how to proceed.
8. Fees and Future Paid Features
Unless expressly stated otherwise, Diasporalia is currently offered without a platform fee for general use. We reserve the right to introduce paid features, subscriptions, promotional tools, or other fee-based services in the future. If we do, we will present the applicable terms, pricing, and any additional conditions before you incur a charge.
9. Intellectual Property
All content, branding, software, design, and technology within Diasporalia are owned by Yordanos Technologies LLC or its licensors. User-generated content remains the property of the respective users, but by posting or uploading content you grant us a non-exclusive, worldwide, royalty-free license to host, display, reproduce, adapt, and distribute that content within the platform for the purpose of operating, improving, and promoting Diasporalia.
10. Third-Party Services and Links
Diasporalia may contain links to third-party websites, app store pages, payment providers, maps, communication tools, or other external services, or may rely on third-party technologies to operate certain features. We do not control and are not responsible for third-party content, policies, practices, availability, or performance. Your use of third-party services is governed by the terms and privacy policies of those third parties.
11. Service Availability and Changes
We may modify, suspend, discontinue, or limit any part of Diasporalia at any time, with or without notice, including features, categories, availability in certain regions, or technical functionality. We do not guarantee uninterrupted availability, error-free operation, or that the service will always meet your expectations or requirements.
12. Limitation of Liability
Diasporalia is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. To the maximum extent permitted by law, we are not liable for disputes between users; user conduct; listing, profile, or message accuracy; transaction losses; deposits, refunds, chargebacks, nonpayment, or failed payments; property condition or damage; personal injury; theft; fraud or scams by users or third parties; missed opportunities; reputational harm; service interruptions; security incidents caused by third parties; or indirect, incidental, special, consequential, exemplary, or punitive damages. Our total liability shall not exceed the amount you paid us for the service giving rise to the claim, unless a different limit is required by law or expressly stated otherwise.
13. Termination
We reserve the right to suspend, restrict, or terminate access to Diasporalia or specific features if we believe a user has violated these terms, created risk for other users, exposed the platform to legal or security risk, or otherwise misused the service. You may stop using the service at any time and may delete your account through the app settings, subject to any legal retention obligations described in our Privacy Policy.
14. Changes to Terms
We may update these Terms of Service from time to time. Continued use of the App or related website experiences after changes become effective constitutes acceptance of the revised terms. Where required, we will provide notice of material changes through the app, the website, email, or another appropriate method.
15. Language Notice
The primary language of Diasporalia, these Terms of Service, legal notices, support responses, company communications, transactional emails, account emails, security emails, automated emails, and other official notices is English unless we expressly choose to provide a communication in another language. For convenience, we may provide translations in the app, website, emails, or other materials. Those translations are offered solely as a convenience, and we are not responsible for translation errors, omissions, delays, or misunderstandings arising from translated content. If there is any conflict, inconsistency, or ambiguity between the English version and a translated version, the English version controls.
